Claims for violations of the False Claim Act and Trafficking Victims Protection Reauthorization Act for misconduct in repairing Mine Resistent Assault Protected Vehicles in Kuwait. MAKS Inc. General Trading and Contracting Co. v. EOD Technology, Inc. Represented Kuwait-registered MAKS in Afghanistan-based expeditionary construction, trespass, and armed robbery action resulting in jury verdict on each of MAKS’s claims and complete rejection of EOD T’s $6 million counterclaim.
Mainawal Rahman Building and Construction Co. v. DynCorp International, LLC. Filed lawsuit in the U.S. District Court for E. D. of Virginia on behalf of an Afghan construction company against DynCorp International, LLC for breach of contract, assault, and conversion for seizing client’s construction equipment and forcing employees off the Gamberi Afghan army base in Jalalabad at gunpoint. After discovery (including depositions in Dubai, UAE), court-guided mediation yielded favorable settlement for client.
Financial Services Litigation. Filed class action lawsuits against Bank of America and American Express in the state courts of California and the District of Columbia for consumer fraud and in the federal courts of California and the District of Columbia for violation of the Right to Financial Privacy Act.
Confidential ICC Arbitration. Represent the state government of a large African country in arbitration against a major U.S. defense contractor in breach of contract action for the defense contractor’s failure to finish construction of a major public works project.
Atlas Internet v. CoolCall.com. Filed breach of contract claim against Iowa-based CoolCall.com, a Voice Over Internet Protocol (“VoIP”) provider on behalf of London-based Atlas Internet in American Arbitration Association’s International Center for Dispute Resolution. Succeeded on all claims and on all defenses to counterclaims.
Kdsti Slassie Tewahdo Church v. Afewerki Simae Ghebreamlak. Successfully represented the Kdsti Slassie Tewahdo Eritrean Church in an action filed in the United States District Court for Maryland to remove a priest who had taken control of the church and valuable church artifacts.
Yemen Oil and Gas Ministry v. Avia Mineralöl AG. Represented the Republic of Yemen in ICC arbitration against a German oil refinery. Traveled to Yemen to consult with Islamic legal scholars and better understand the facts of dispute and to meet with Shari’ah law experts on issues related to the award of judgment interest. Drafted and filed arbitration brief that defeated Avia’s motion to bar the award of pre- and post-judgment interest on Yemen’s seventeen year-old, multi-billion dollar claim against Avia.
Lockheed Martin Corporation v. Federal Republic of Germany. Represented Lockheed Martin in ICC arbitration brought against the Federal Republic of Germany (“FRG”) for the FRG’s refusal to fully pay for the purchase and installation of RRP-117 radars. Regularly traveled regularly to Syracuse, NY to master facts and become familiar with technical challenges to RRP-117 radar deployment in the Fulda Gap.
Joseph Lemire v. Ukraine. Represented Joseph Lemire in International Centre for the Settlement of Investment Disputes (“ICSID”) arbitration filed against Ukraine for the expropriation of Mr. Lemire’s investment in Gala Radio.
In Re Honda Dealership Relations MDL. Represented impled defendant William E. Schuiling the U.S. District Court for Maryland. Conducted document review that uncovered hand-written notes of Sherry Cameron, Honda’s internal investigator, on documents referencing Mr. Schuiling. Drafted, edited, and filed motion to dismiss based on Ms. Cameron’s knowledge of claims against Mr. Schuiling and the running of the statute of limitations on Honda’s impleader action against him. After a hearing before Judge Motz on the motion, Mr. Schuiling was dismissed as a defendant in the MDL
